Stationary Sources of Greenhouse Gases

This spring, the U.S. Supreme Court will consider whether the Clean Air Act is flexible enough to allow the U.S. EPA to regulate greenhouse gases from stationary sources, such as industrial facilities. But it has refused to hear an appeal of the D.C. Circuit's ruling that greenhouse gases, by contributing to climate change, present a danger to the environment. Will the Court now allow the EPA to control greenhouse gases that come from stationary sources?

Regulation of Carbon Emissions for Existing Power Plants Under the Clean Air Act

While the Environmental Protection Agency's recently proposed emissions standards for new power plants were controversial, the debate over how to limit the greenhouse gas (GHG) emissions of the largest source in the country, existing fossil-fueled power plants, is of much greater consequence.

Carbon dioxide (CO2) constituted 84 percent of GHG emissions in 2011. The electric power industry accounted for 33 percent of these GHG emissions, with coal plants leading the way as the worst source of this pollution.

Severe Weather Events and the National Flood Insurance Program

Typhoon Haiyan-one of the most powerful "superstorms" in recorded history-caused more than 5,200 deaths and displaced an estimated four million people in the Philippines this fall. Kerry Emanuel, professor of Atmospheric Science at M.I.T., predicts an increase in the intensity and frequency of tropical cyclones as a consequence of climate disruption-the warming of the planet due to the steady increase in greenhouse gases. If this prediction is accurate, more powerful storms will make landfall more frequently in the U.S. over the course of the next several decades and beyond. These storms are likely to play an increasingly prominent role in U.S. politics, policy, and law as debate grows over
the issue of who should bear the costs of recovery and restoration. One of the most contentious issues in 2014 may prove to be reform of the National Flood Insurance Program ("NFIP").

Obama's Decision on the Keystone XL Pipeline

In 2014, President Obama will decide whether to block or allow the proposed Keystone XL pipeline, which would increase the transportation of oil from Canada to Gulf Coast refineries. The pending decision symbolizes a fundamental choice for the United States and the world regarding a reduced-carbon future.

The proposed Keystone XL would transport bituminous ("tar sand") oil from Alberta, Canada to Steele City, Nebraska, and then to Texas, thereby connecting the Canadian tar sands region to refineries and ports on the Gulf Coast.

Growing Climate Change: The Farm Bill as Comprehensive Climate Change Policy
